CrPC 268 (1) stops transfer of Bishnoi from Gujarat jail to Mumbai

MUMBAI: Earlier in June this year, Mumbai police crime branch had sent a request to Union home ministry seeking exemption in the Criminal Conspiracy Code (CrPC) 268 (1) case, seeking the custody of gangster Lawrence Bishnoi who has been threatening actor Salman Khan for a while.

Bishnoi has been lodged in Sabarmati Jail for the past year. He faces multiple cases, including for murder, attempted murder, extortion, and drugs and weapon smuggling, filed by forces in Punjab, Delhi, Gujarat and Mumbai. Officials have encountered hurdles in securing his custody from Sabarmati Jail due to an order issued by home ministry in Oct last year under Section 268 (1). This section allows the state government to direct that a person or class of persons shall not be removed from prison, overriding any orders made under Section 267 (power to require attendance of prisoners).

Bishnoi was arrested by NIA in connection with terror funding to Khalistan supporters. Centre had invoked CrPC 268 following request from NIA. CrPC 268 orders was to end in Aug, but Centre extended the order by another year.
